How to File a Trademark Application in the U.S. - Part 1

If you scroll down, you will see a box that?s called TEAS, which refers to the Trademark Electronic Application System.? This is where you can file forms online, including a trademark application.?

Once you click that, it takes you to the actual TEAS System.? Here, again, you can find valuable information that will help you along the process of registering your trademark with the USPTO.? However, I?m going to give you that step-by-step guide right now.?

The first thing you do is click on the initial application form.? Once you click there, it gives you information related to the different kinds of applications that you can file.? The first one is most likely the one that you will be applying for.? It is a trademark or service mark application on the principal register.? While there is another option for the trademark or service mark application on the supplemental register, more often than not, you?re going to start by attempting to get your mark registered with the principal register, which is reserved for marks that are not merely descriptive, but instead, are, in fact, distinctive trademarks or service marks.?

Once you click on that, you will see there are different options for how you can file online.? The first is the TEAS Plus Form, which is a $275 nonrefundable filing fee that goes directly to the USPTO.? The second option is the TEAS Form, which is a $325 option.? The difference between the two is outlined in the language here.? Simply put, the TEAS Plus form requires that you provide enough information that does not require the USPTO to complete the application for you, which is why it?s cheaper.? I suggest that you start with the Teas Plus form, especially if you?ve consulted with a trademark attorney or are walking through this on a step-by-step basis with me here today.?
Once you select that and continue, again, there is a lot of information related to what you need to do.? The first step is to determine whether or not an attorney is filing this application.? Since I?m walking you through this, and you?re filing it on your own, an attorney is likely not filing this application.? While I?m giving you a step-by-step guide, I am not your attorney and I do not represent you unless you contact me and my firm and retain me to do so.? So, you would click no, an attorney is not filing this application, and then, you can press the continue button.??

Next, you will get an informational message that tells you what kind of requirements you need for your web browser.? If you?ve made it this far, you?re likely okay and you can close that box.? The first screen requires applicant information and this pertains to who you are as the owner of that particular trademark.? This is where you put information that relates to you or your business.? So, if, in fact, you as an individual are filing, you would put your first and last name and middle initial here.? Last name first, followed by first name and then middle initial.? My name is Brian A. Hall and this is what I would put if I were filing for this individually (Hall, Brian A.)?

I would then come down to the entity type and select individual.? And it requires that you select a country of citizenship.? Now, the thing that?s important for you to recognize here is that the owner of the mark will be the person that is displayed as the registrant of the trademark once it is registered with the United States Patent and Trademark Office.? It needs to reflect actual ownership of the mark.? And what?s important to recognize is that if you select an individual owner, you as the individual may be held liable for trademark infringement.? This risk of personal liability oftentimes leads people to form some sort of corporate entity to provide themselves with a liability shield.? Other times, people select a different entity such as a corporation or LLC because, in fact, the trademark, indeed, is owned by that entity.? It is important for you to consult with an attorney if you have questions relating to who should be the owner of the trademark.?

As you scroll down, it asks for additional information such as your address.? I am inputting the address of my law firm.? It asks for the city in which you are located.? It asks for the state, your zip code. The phone number and fax number are not required.? You can see next to both of these that there is not this small red asterisk.? If the asterisk is not there, it means that you do not need to provide this information.? You should recognize that anything you put into this application becomes public record and can be searched and found by anybody out there.? As such, you need to make a determination whether or not you want that information publicly available.?

What is next required is, indeed, a valid email address.? And if you wish, you can check this box that gives the USPTO authorization to communicate with you via email as opposed to in writing in regular postage mail.? If, in fact, you are someone that regularly checks your email, I would recommend that you use the email option.? After you have completed that information, once again, all the information that?s required as indicated by the asterisk, you can go to the next screen.

Now, this warning screen is something that is typical, and what it?s saying is that a telephone number has not been entered and it gives you that information that I just talked about, namely that it?s optional.? If you would like to include it, you can go back and include it.? If you?d like to move forward, you can continue on.?

This next screen is where you?re going to input information related to your actual trademark or service mark.? And just so we?re speaking the same language, a trademark is merely a mark that refers to a good, whereas a service mark refers to a service.?? Under law, they are essentially treated the same way.? So, on this screen, you can enter your mark.? This is where you need to put exactly the mark that you want to see protection for.? I?m going to use the example of ?mark?.? And this is where it?s important for you to recognize the different kinds of marks that are available.?

The first is what?s known as a standard characters mark. And this, in particular, is protecting only the characters or the word or term itself.? If you want protection for something beyond that, you can select what?s known as a special form stylized and/or design mark, and that will change the form and require that you add additional information.? And the difference between a standard character mark and specialized form mark is that the specialized form mark has a logo component or some specific design to which you want to protect above and beyond the actual characters or terms that are associated with the standard character mark.?

So, simply put, if you?re looking to protect a logo, you would use the special form.? If you want to protect a type of color or specific design or font, you would use the special form.? But, if, indeed, you?re simply looking to protect your standard characters, you will use the original one that is defaulted to that I had written the term ?MARK? into.? If you are unsure what the mark will look like, you can preview what the image show, and you can see that it simply puts the mark as it?s displayed in character form for you to review.?

Contrast that, with the special form or stylized design, which requires that you attach a properly sized JPEG image as set forth here, it also requires that you include the literal element of the mark.? And what that means is that if you have logo that?s associated with the term ?MARK?, you would include ?MARK? here, but include and attach your JPEG image showing the actual logo.?

As I stated before, if you are claiming color as a feature of the mark, you need to set forth specifically what the colors are that you are looking to protect.? If you?re not looking to protect the color, you must check this box that says you?re not claiming color as a feature of the mark.

?And finally, the USPTO requires that you enter a complete and accurate description of the entire mark.? So, if, in fact, it is a logo mark that includes the word ?MARK? with a shield around it, you might put something like (the mark consists of a shield over the word MARK.)? This allows the description to show exactly what you?re applying for.?

If you return to the standard character mark and add the term ?MARK?, you?ll see that there is one more box where you can make an additional statement.? And if you check that box, it expands to show a lot of information that may be relevant to your application.? And while a trademark attorney can walk you through the specifics related to each of these, you can glean a lot of information by basically reading through each item.? I will try to walk you through them at a high level right now.

A disclaimer means that you are not claiming an exclusive right to use a certain portion of the mark.? If, in fact, you are unsure, you can apply for your trademark registration and the United States Patent and Trademark Office examining attorney will review it and notify you if, in fact, they are requiring a disclaimer.? Therefore, do not worry necessarily if you are unsure whether or not a disclaimer should be added.

The next item refers to prior registrations.? If you have ownership of other trademarks that are registered with the USPTO that are similar to this particular application, you should note them here.? This will help avoid the examining attorney issuing an office action that initially refuses registration of your application due to a likelihood of confusion with an existing registration at the USPTO.?

The next one includes information related to translations.? If your trademark application includes words that have a meaning in a foreign language, you need to translate those for the USPTO.?

The next one, transliteration, requires that you provide whether or not non-Latin characters have a particular meaning in the English language or a foreign language.

The next one refers to meaning or significance of wording, letters, or numerals.? If, in fact, there?s something that?s part of your trademark that is a term of art in your relevant trade or industry, you must note it here.? The reason being is that the USPTO does not want to give you an exclusive right to use a particular term in an industry or in connection with those goods or services if, in fact, it?s something that is common and/or descriptive of an actual relevant trade or industry term.?

The next one refers to Section 2(f) based on use.? What this means is that if your mark is merely descriptive, you are not entitled to trademark registration.? However, through continuous use for at least five years or your ability to establish secondary meaning through scope of advertisement, number of advertising dollars, and overall usage, you can make a registration claim based upon Section 2(f).? In all likelihood, if you are applying for a trademark and you are getting into this level of detail, you?d be well served retaining a trademark attorney to help walk you through whether or not your application should be based on 2(f) or not.? Keep in mind, if you apply for your trademark and do not indicate it as a 2(f) application, the examining attorney from the USPTO can review it and let you know that you must base your application on Section 2(f) or face having your mark not registered.?

With GPS-equipped smartphones becoming more prevalent every day, is there still a place for $400 personal navigation devices? The Garmin n?vi 3590LMT ($399.99 list) is the first in the company's new Prestige line, and presents that very question.?With the 3590LMT, you get Garmin's most advanced traffic and terrain reporting to date, plus a responsive, glass capacitive touch screen that's superior to the plastic resistive screens nearly every other PND employs. Despite a few minor issues, it's a stellar performer and our new Editors' Choice for high-end GPS navigation devices.

Design, Display, and Mount
The Garmin n?vi 3590LMT isn't as svelte as its predecessor, the n?vi 3790T (4 stars). The 3590LMT measures 3.4 by 5.4 by 0.5 inches (HWD) and weighs 7.2 ounces. Even though the new model has a 5-inch screen, and the older 3790T was limited to a 4.3-inch display, the 3790T is significantly smaller. You could argue it doesn't matter, since both units are designed for in-car use. But either way, it's a curious step backwards.

On the plus side, the larger display is the best part of the 3590LMT. The glass capacitive touch screen sports a sharp 800-by-480-pixel resolution, which puts it far ahead of the similar TomTom GO 2535 M LIVE ($349.95, 4 stars). The Garmin's display looked very bright and colorful in testing, and easily stands up to bright sunlight in the car. Better still is its response; it feels like a good Android phone or iPhone, and much more receptive to touch than the plastic resistive screens found on most personal navigation devices.

One persistent nit: the charging cables. The unit itself and the mount each have charging ports. This is great, as it lets you charge the unit directly, as well as leave a cable attached to the mount on the windshield, with the other end in a power socket in your car. But while the 3590LMT employs micro USB, as is typical for most of today's cell phones, the mount contains an older mini USB port. It's not a huge problem, since the unit comes with the proper cables, and since you'll likely only need the mini USB one in the car. But it's still silly to employ two different charging connectors on a single product.

POI Search, Map Graphics, and Lane Assistance
With the 3590LMT, you get free lifetime maps and traffic (hence the 'LMT' designation in the model name), plus a database containing nearly 8 million points of interest (POIs). Garmin continues to refine its POI category breakdown, and in our opinion, it's still the best in the business. The new voice activation is a welcome addition, and performs better in testing than Magellan's comparable feature (which admittedly has been around a while now). With the 3590LMT, you say "voice command," followed by a decent selection of choices, including going home, searching for nearby POIs, stopping navigation, and changing the volume or display brightness, among other things.

Garmin also attempted to improve the way you input addresses in the 3590LMT, but the results are mixed. There's a type-ahead feature that searches as you type, but you have to remember to change the city and state first, using the small button on the top right. Otherwise, the type-ahead will never figure out the correct street. Plus, you can't specifically set the state, at least in the New York area. I searched for a specific city in New Jersey, but it also popped up examples in other states; when I scrolled down to select the one in New Jersey, it didn't register even after four or five tries. Then, without explanation, it did register and move onto the next screen?but there was no easy way, once I began navigation, to see if it did in fact choose the right one. I had to bring up the full step-by-step route list to make sure it got the right city.

Once on the road, all of the Garmin's minor issues fall away. The map graphics are absolutely gorgeous. The sharp resolution and vibrant color of the capacitive touch screen, combined with a faster processor and near 30-frames-per-second animation, make for an especially slick presentation. Sometimes, during testing, I saw more stutters when the road bent to the left or right, when the 3590LMT needed to swing the map around to keep my heading at the top, but otherwise it was very smooth. There are plenty of thoughtful touches throughout, including 3D terrain mapping and elevation data, and newly rendered 3D buildings in major cities, all of which put the 3590LMT a step ahead of every other standalone device on the market.

Especially attractive are the new, photo-realistic lane assistance graphics. Instead of switching the entire map view to a full-screen, rendered 3D graphic, now it splits the screen in two, and the right side shows the exit signs and appropriate arrows. Not only do the road signs display the right text, but the background on the road matched what I saw in real life. For example, on I-195 in New Jersey, there were trees along the side of the road. But on the New Jersey Turnpike further north, it showed the industrial structures and highway lamps along the side of the road, and even the concrete divider in the center. I almost expected to see a nearby Ikea store on the display, too.

My dog Susie says

Are pets more ?pain? than pleasure?

Since I'm just a dog and the writer of this blog, I probably seem slightly prejudiced on this question. However, I'm going to keep my analysis as unbiased and based on facts...as I can. A few months ago I wrote a 'bark' about the health benefits of owning a dog from the prospective of Americans. Let's look at some of the comments from other places around the globe.

England's young royals, Prince William and the Duchess of Cambridge Kate Middleton were recently photographed walking with their black Cocker Spaniel puppy named Lupo. Doctors and medical experts around Europe immediately forecast an increase in longevity for the couple. Dog owners enjoy longer and more positive lifespans because of reduced blood pressure and obesity resulting in robust cardiovascular fitness.? Score one point for pet pleasure.

Let's talk about the mental side of all of this. It seems that owning a pet, like a dog, also greatly enhances one's self-esteem while reducing depression. So while walking a dog helps in the physical side, owning a pet can facilitate the development of social contacts leading to a more optimistic view of your personal life and where it's heading. This is way better than Zanex. Score another point for pets.?

German's studies showed that pet owners spent 32% less time in hospitals than non-pet owners and saved over $5 billion in health care costs. Australian studies proved that pet owners went to the doctor 12% less and saved over $3 billion annually in health care expenditures. Even in China studies have shown that having a pet in the home greatly reduced doctor visits and sick days at work. Chinese women even refer to their dogs as son or daughter... a surrogate for their missing children who have moved out. Taking care of their pets helps alleviate their loneliness. ?And pets don't talk back and are nonjudgmental listeners? according to many Chinese mothers. Score point three for pets in the pleasure column.

I asked my Big Mommy, Sandy, if she could help with the negative side of the question. I wondered how much the average pet owner spent on their pets. It seems that the ?average? owner spends about $300- $500/year for medical expenses like checkups at the Vet, vaccinations, pills etc. Food and treats costs another $250-$500 a year for a dog. She doesn't have any idea what a cat or goldfish might cost. So it looks like an average pet-owner (dog) probably spends up to $1,000 more per year than a non-owner. So score one point for ?pain?. If your pet has to have an operation then score two more point for ?pain? both mentally and monetarily.

It looks like a tie between pain and pleasure. However, studies for children with autism showed dramatic improvement when a dog was present in their home. Military dogs have not only saved soldiers during war for generations, but also aided returning warriors who have been physically disabled or mentally traumatized. Canines are also being used to reduce pain and suffering for humans at hospitals, psychiatric venues, prisons, schools and nursing homes. I could go on and on but it seems to me that the benefits of owning pets are overwhelmingly positive. Whatever a pet may cost in money, it's returned a hundred fold in health and happiness.

Nodding off in class may not be such a bad idea after all. New research from the University of Notre Dame shows that going to sleep shortly after learning new material is most beneficial for recall,

Titled "Memory for Semantically Related and Unrelated Declarative Information: The Benefit of Sleep, the Cost of Wake," the study was published March 22 in PLOS One.

Notre Dame Psychologist Jessica Payne and colleagues studied 207 students who habitually slept for at least six hours per night. Participants were randomly assigned to study declarative, semantically related or unrelated word pairs at 9:00 a.m. or 9:00 p.m., and returned for testing 30 minutes, 12 hours or 24 hours later. Declarative memory refers to the ability to consciously remember facts and events, and can be broken down into episodic memory (memory for events) and semantic memory (memory for facts about the world). People routinely use both types of memory every day ? recalling where we parked today or learning how a colleague prefers to be addressed.

At the 12-hour retest, memory overall was superior following a night of sleep compared to a day of wakefulness. However, this performance difference was a result of a pronounced deterioration in memory for unrelated word pairs; there was no sleep-wake difference for related word pairs. At the 24-hour retest, with all subjects having received both a full night of sleep and a full day of wakefulness, subjects' memories were superior when sleep occurred shortly after learning, rather than following a full day of wakefulness.

"Our study confirms that sleeping directly after learning something new is beneficial for memory. What's novel about this study is that we tried to shine light on sleep's influence on both types of declarative memory by studying semantically unrelated and related word pairs," Payne says.

"Since we found that sleeping soon after learning benefited both types of memory, this means that it would be a good thing to rehearse any information you need to remember just prior to going to bed. In some sense, you may be 'telling' the sleeping brain what to consolidate."

Making mouse memories

Neuroscientists create a synthetic recollection of fear in rodents

In the movie Eternal Sunshine of the Spotless Mind, scientists erase troubling memories from Jim Carrey?s head. In real life, scientists have done the opposite.

By reactivating certain nerve cells, researchers make artificial memories pop into mice?s heads. The results, published in the March 23 Science and online March 22 in Nature, offer a deeper understanding of how the brain creates and uses memories.

Much of what scientists know about how the brain remembers comes from studies that look for signs of natural memories in the brain or that disrupt memories. In the new work, memories are actually created, says neuroscientist Richard Morris of the University of Edinburgh in Scotland. ?To my mind, this is an extremely important step forward,? he says.

Though the two teams used different approaches, they both created a false memory of a fearful situation in mice. In the work reported in Science, neuroscientist Mark Mayford and colleagues relied on a molecule that, upon binding a particular drug, could activate nerve cells. The team genetically engineered the mice so that only the nerve cells active during the formation of a particular memory would make the molecule. In a sense, this molecule acts as a trail of bread crumbs in a forest, marking cells in the brain that make a memory and allowing scientists to reactivate those cells later.

The marked memory was of a square room with opaque white walls and floor, and no particular odors. The mice played in this room, had their memory tagged and later went into a different room ? this time, a wintergreen-scented room with a black-and-white checkered wall and a gridded floor. Here, the animals were subjected to shocks. After a while, the animals learned to freeze in response to being in the room.

In some of the trials, the researchers reactivated the memory of the white room during the shock session. This taught the mouse to associate the combination of the reactivated memory and the scented room with a shock, forming a hybrid memory. Sure enough, in later trials, these mice froze only when researchers placed the mice in the second room and simultaneously reactivated the artificial memory. ?We?ve essentially created a synthetic memory,? says Mayford of the Scripps Research Institute and the University of California, San Diego in La Jolla.

Of course, no one knows what the experience was like for the mice. But the data suggest that rather than toggling back and forth, the sensation would be more like a hybrid between the two places.

The study in Nature, led by Susumu Tonegawa of MIT, labeled and recreated a fearful memory in mice using molecules that respond to certain kinds of light, a technique called optogenetics. A day after the fearful experience, in an entirely different room, the animals froze in fear when the light was turned on and the artificial memory was called to mind. This flash of light ?led to the entire recall of yesterday?s terrible experience,? says Tonegawa. Minutes later when the light was turned off, the mice moved normally.

The results are ?a dramatic way to demonstrate that behavior is actually based on very specific changes in the brain,? Tonegawa says. Stimulating a small number of nerve cells led to a complex behavioral response.

Compared to what the mouse?s brain normally does to call up a memory, these artificial reconstructions are crude. ?We were surprised that it didn?t make a mess out of the animal, and that the mouse could use it at all,? Mayford says.

An odd, previously unseen landform could provide a window into the geological history of Mars, according to new research by University of Washington geologists.

They call the structures periodic bedrock ridges (and they use the abbreviation PBRs to evoke a favorite brand of beer). The ridges look like sand dunes but, rather than being made from material piled up by the wind, the scientists say the ridges actually form from wind erosion of bedrock.

"These bedforms look for all the world like sand dunes but they are carved into hard rock by wind," said David Montgomery, a UW professor of Earth and space sciences. It is something there are not many analogs for on Earth."

He believes the ridges, while still bedrock, are composed of a softer, more erodible material than typical bedrock and were formed by an unusual form of wind erosion that occurs perpendicular to the prevailing wind rather than in the same direction.

He contrasts the ridges with another bedrock form called a yardang, which has been carved over time by headwinds. A yardang has a wide, blunt leading edge in the face of the wind, and its sides are tapered so that it resembles a teardrop.

In the case of periodic bedrock ridges, Montgomery believes high surface winds on Mars are deflected into the air by a land formation, and they erode the bedrock in the area where they settle back to the surface.

Spacing between ridges depends on how long it takes for the winds to come back to the surface, and that is determined by the strength of the wind, the size of the deflection and the density of the atmosphere, he said.

The discovery is important because if the ridges were actually created by wind depositing material into dunes, "you're not going to have information from any prior history of the material that is exposed at the surface," he said.

"But if it's cut into instead, and you're looking at the residual of a rock that has been eroded away, you can still get the history of what was happening long ago from that spot," Montgomery said.

"You could actually go back and look at some earlier eras in Martian history, and the wind would have done us the favor of exposing the layers that would have that history within it," he said. "There are some areas of the Martian surface, potentially large areas, that up until now we've thought you couldn't really get very far back into Mars history geologically."

Montgomery is the lead author of a paper documenting the discovery published online March 9 in the Journal of Geophysical Research, a journal of the American Geophysical Union. Coauthors are Joshua Bandfield, a UW research assistant professor of Earth and space sciences, and Scott Becker, who did the work as an undergraduate in Earth and space sciences and has received his degree. The work was funded in part by NASA.

There could be landforms on Earth that are somewhat similar to periodic bedrock ridges, Montgomery said, but to date there's nothing exactly like it, largely because there are not many bedrock landscapes on Earth in which wind is the main erosion agent.

My understanding of the law as it relates to an original band, with no documented band agreement in place is:

The Copyright Act ?101 defines a ?joint work? as ?work prepared by two or more authors with the intention that their contributions be merged into inseparable or interdependent parts of the unitary whole.?

In our case, we have played LIVE with this music and recorded it with the intentions of distributing it. Both guitar players decided to leave the band and create a separate project. They claim that they own all the music since they wrote the guitar parts. Not considering that the rest of us help author those guitar parts and we created the Vocals, Melodies, Drums and Bass lines to create a "Whole Song".

With no documented band agreement in place, and the intentions of playing LIVE and distribution noted above, shouldn't the following statement apply to this situation?

Parts of a unitary whole are ?inseparable? when they have little or no independent meaning standing alone. That would often be true of a work of written text, such as the play, that is the subject of the pending litigation.
By contrast, parts of a unitary whole are ?interdependent? when they have some meaning standing alone but achieve their primary significance because of their combined effect, as in the case of the words and music of a song.
